MEDICOVER Genetics is providing the SIRIUS software as a service exclusively to the customers of the company’s TarCET range of IVD reagent kits and to Technology Transfer customers.
Use of this product signifies the agreement of any user of the SIRIUS software with the following terms:
i. The SIRIUS software may be used solely in accordance with the instructions of use (IFU) SIRIUS software workflow which is provided from MEDICOVER Genetics and only with components described in the IFU.
ii. MEDICOVER Genetics grants no license to use the SIRIUS software with any component not included within the kit except as described in the IFU.
This product may include a limited, not‐transferable license under Cyprus law and patents owned by MEDICOVER Genetics.
iii. The software is only to be used only by a healthcare professional such as physicians, laboratory scientists, geneticists, genetic counselors etc.
iv. The user should be at least eighteen (18) years old.
If you do not agree with the above terms, do not use this product.
When registering to use the MEDICOVER Genetics services, SIRIUS requires the user to create an account. Once the user is registered to the MEDICOVER Genetics services, the user may upload raw data including but not limited to clinical information, individual’s genetic data, family data, or other relevant data. Unless there is a signed contract with the company that indicates otherwise, the user should not submit any patient identifiable information such as patient’s name, patient’s address, and other relevant information. The user is responsible for removing all patient identifiable information or the user is responsible for what patient information is provided.
MEDICOVER Genetics takes the privacy and confidentiality of our users as a top priority. That is why we pledge to respect the privacy of personal data, to remain transparent and to keep user’s data safe. For further information regarding the collection and the processing of the user’s personal data from MEDICOVER Genetics, please refer to our Privacy Policy. The name, surname and email address of the laboratory supervisor and the user will be collected during the setup of the account. These personal data will be retained for the lifetime of the product and 10 years after it. Raw genetic data uploaded on the software will be retained for 6 months. The user has the option to object to the processing of personal data, by sending an email to our Data Protection Officer at dpo@nipd.com.
All content included in or made available through any MEDICOVER Genetics Service, such as logos, text, graphics, images and software are the property of MEDICOVER Genetics and protected by Cypriot and international copyright and trademark laws.
MEDICOVER Genetics name and logo and MEDICOVER Genetics products names and logos are registered trademarks of MEDICOVER Genetics. All other names of third-party products or companies cited in this website are property of their respective owners and may also be trademarks. Inclusion of the product or company names in this website does not imply endorsement by MEDICOVER Genetics. Also, any graphics, page headers and service names included in or made available through any MEDICOVER Genetics website are trademarks or trade dress of MEDICOVER Genetics.
MEDICOVER Genetics has the obligation to:
Provide the user of the SIRIUS software and any other product belonging to MEDICOVER Genetics, with a detailed instructions for use (IFU) leaflet.
The users of the SIRIUS software have the obligations to respect all the related legislations of the Cypriot and International Law. The users must use our software only in accordance with the applicable Terms and conditions. It is necessary to use the SIRIUS software by fully trained personnel according to the MEDICOVER Genetics standards. Additionally, the users undertake not to:
· Use or attempt to use the SIRIUS software, except as provided in these Term and Conditions and also by the instructions for use (IFU) provided by MEDICOVER Genetics.
· Damage or attempt to damage directly or indirectly the reputation or image of MEDICOVER Genetics, the software service and generally the rights held by MEDICOVER Genetics, in any way whatsoever,
· Distribute, publish or sell information or the software itself. The use of the SIRIUS software is strictly for the user only and any type of processing or distributing to third parties is prohibited,
· Allow, directly or indirectly, by advice, help or assistance, any third party to carry out the abovementioned acts or infringe MEDICOVER Genetics intellectual property rights,
· Take any advice, help or assistance from any third party regarding the SIRIUS software but also any other product belonging to MEDICOVER Genetics. For any help, information and report of a technical problem please contact MEDICOVER Genetics directly using the contact details provided at the end of these Terms and Conditions, to avoid any misinformation or alteration of our product.
· Reverse engineer software on other products.
In addition, the user covenants to inform MEDICOVER Genetics as soon as the user becomes aware of any illegal or improper use of the MEDICOVER Genetics website or elements on the website including our products and services.
MEDICOVER Genetics guarantees that the SIRIUS software will operate in conformity with the current standard documentation. In case the SIRIUS software or any other product that belongs to MEDICOVER Genetics does not perform in accordance with the foregoing warranty, the user should immediately inform the company in writing and once such nonconformity is verified the company will use reasonable efforts to correct any deficiencies in the product so that it will perform in accordance with such warranty. In case of any defect, after the Warranty Period, the user should immediately inform the company who will examine the situation.[A62]
MEDICOVER Genetics website and all the available services offered or contained herein including the SIRIUS software, are provided on “AS IS”. That means the user is accepting the product in whatever condition it is in and “with all faults”, whether immediately apparent. Neither MEDICOVER Genetics, its affiliates, employees or representatives will be liable for damage arising out or in connection with; access to, use of, or inability to use this site.
This is a comprehensive limitation of liability that applies to all damage of any kind.
These Terms and Conditions shall be governed and be exclusively subject to the Cypriot and International Laws. Any dispute arising from these Terms and Conditions shall be settled through the competent courts of Cyprus.
